501 (c)(3) & The Church
Sorry
it took me so long to post again, but this message took a lot of research to
complete. I am going to start my blog debut out with an extremely light topic
about the Church and its relationship with the government or more specifically
how the 501 (c)(3) exemptions affect the Church. This will be a lengthy post,
but I assure you it will be WELL worth your time reading it all and personally,
I learned a lot!
Any
company that files for a 501(c)(3) status exemption is considered to be a “nonprofit”
organization under United States Federal Law “26 U.S.C. § 501”, and as
such these companies are exempt from all Federal income taxes and fall under all
501 (c)(3) rules. One rule is that any organization that is under 501(c)(3) rules
can receive “unlimited” contributions from individuals, corporations, or unions
and never have to pay one penny in taxes. The second rule is that all nonprofit
organizations are considered to be tax-exempt under section 501(c)(3) if its
primary activities are charitable, religious, educational, scientific,
literary, testing for public safety, fostering amateur sports competitions,
preventing cruelty to children, or preventing cruelty to animals. However, the
501 (c)(3) exemption is only 1 of 29 variations and the other 28 cover such things
as corporations, civic leagues, labor/agricultural or horticultural
organizations, chambers of commerce, real estate boards, title holding
companies, fraternities & sororities, teacher’s retirement fund
associations, and the list goes on so why is this important and why are 501 (c)(3)
exemptions bad? The main reason is that once you become a 501 (c)(3) applicant you
are now beholding to the U.S. Government and whatever laws they want to add or
change to 501 (c)(3) companies the 501 (c)(3) companies must follow to the
letter. So should a Church be a part of this 501 (c)(3) exemption that the “world”
is offering them? Let’s take a look at 501 (c)(3) exemptions.
Section
I – Introduction
Many churches use 501 (cc) (3) applications to seek
tax-exempt status to function as churches. However, when you ask those churches
what the numbers and letters mean they have no clue, but do you?
Section
II – What Is A 501 (c)(3)?
The 501 (cc) (3) application form outlines a statute written
by Congress and written fully it would be “26 USC 501 (c)(3)”, which stands for
“Title 26 of the United States Code Section 501 paragraph c subparagraph 3”. However,
title 26 is more commonly referred to the general public as the “Internal
Revenue Code”, and notice that it does not read the “Internal Revenue Law”. We
have to remember that Congress passes laws and not codes and that they do it in
no particular order. This means that a separate office in the Congress takes
these public laws and organizes all these laws passed by Congress into 50
organized “code books” called “titles” covering different areas of the law.
This means that there is room for error when people dabble with the laws passed
by Congress and form them into organized bodies of statues and refer to them as
the Internal Revenue Code. You can read more about these rules at the website
below entitled “How to Lose Your 501 (c)(3) Tax Exempt Status”. The language of
any law always controls what the law is, but the language of the “code” does
not. This means that if they decide the law meant this instead of that then all
churches operating under the 501 (c)(3) exemptions would have to change how
they operate churches and this means YOUR church too if it is under the 501
(c)(3)! Are you starting to see the issue here?
Some of the volumes of coded laws
organized under a Title are enacted into positive law and the Federal Courts
may use any of these laws as they see fit. This means that the federal courts
may presume that the
codified statutes are error free renditions of the actual laws passed by
Congress and that they can be used as evidence of those laws. Courts that have
enacted these codes into positive law have been implementing regulations
written by the executive branch and then describing how the public is to comply
with the laws (aka codes). After this the regulations are published in
the Federal Register so
that people will know what these laws require of them in regard to their 501
(c) exemptions and these regulations
cannot alter the statute in any way. However,
other codified statutes are not enacted into positive law and are
private law for officers/employees of the federal government (how convenient). At
this point we MUST understand that Title
26 of the US Code Section 501c3 (aka IRS code) has NEVER been enacted into law.
However, it is only prima facie
or accepted as correct until proved otherwise. In this case it is the evidence of what the law
actually is and all of these presumptions automatically stand as evidence only
until they are challenged. Because of this any person or organization that
files a 501c3 application is in reality giving their consent to be governed by
private and unpublished statutes like Title 26 501 (c)(3) and that no one is forced to file for a 501
(c)(3) application by which subjecting their church to the jurisdiction of
criminal laws. So the 501 (c)(3) is not an actual law but only a “code” that
they the government can change anytime they want and anyone under the 501
(c)(3) exemption MUST obey it! Now do you really think God’s Church should be
using this 501 (c)(3) exemption? No? Well there is MUCH more…
Section III – What Happens When Your Church Submits A 501 (c)(3)?
When churches files an IRS 501 (c)(3)
applications they are giving their consent to be governed by all applicable 501
(c)(3) statutes, laws, and rules that pertain to the IRS. A church which has
filed a 501 (c)(3) in affect agrees to forego all of its Constitutional rights
to practice religion without government interference. This means that it disestablishes its religious nature
with Jesus Christ as its head and now becomes instead a secular agency of
government policy against which the church will not be able to speak out
against sin and to which it gives its consent to be silent anything that the
government says that they must. Because of this 501 (c)(3) churches can only
operate under the 'color' of religion, and such ministries are soundly
condemned by Jesus. Matthew 7:21 tells us that “ Not
everyone that saith unto me, Lord, Lord, shall enter into the kingdom of
heaven; but he that doeth the will of my Father which is in heaven” and a church that has built boundaries around itself
by 501 (c)(3) rules has consented to diminish God's law in favor of private
civil law. One example of this would be that a church would have to agree not to
speak out or campaign against a morally corrupt politician or speak out against
a certain sin such as homosexual marriages because the 501 (c)(3) rules say
that kind of speech is “hate speech”. Any church that consents to government
censorship so they can maintain their 501 (c)(3) status is in fact serving masters,
PERIOD and this is a contradiction of scripture for it clearly says we cannot
serve two masters (Matthew 6:24). So churches need to decide if they are going
to continue the way they are and support the worlds system known as the “501
(c)(3) Exemption” or will they walk away from the 501 (c)(3) satanic trap and
start serving God again. Scrupulously following 501 (c)(3) ministers freely consent not to speak God's
inconvenient truth because they have agreed to censor themselves for an
artificial unneeded financial perk.
You must understand that the IRS is not to blame
when conflicts between church doctrine and 501 (c)(3) rules because the IRS in
accordance with the all the laws of the Constitution warns churches that they do not have to seek
IRS jurisdiction to be tax exempt. This means that churches who have consented of
their own free to silence themselves in their 501 (c) (3)
applications cannot complain of injury to their constitutional rights when
they must comply with IRS 501 (c)(3) rules. In addition, this means that churches
could be forced to hire homosexual teachers for their schools, mandate
abortions on demand in Catholic or other Christian based hospitals, or any other
federal codes and policies that the government wishes to attach to 501 (c)(3)
applicants. Finally, federal courts routinely stand up for the IRS
against churches who have filed a 501 (c)(3) complaint of infringement on
their constitutional rights and the courts are right to do so because it is a
maxim of law that one who consents cannot complain of injury. Are you starting
to see how serious this simple little tax exemption is? It is a SATANIC TRAP
and many ministers believe that they must by law seek
IRS exemption from federal taxes even though in its various publications the
IRS disagrees with that unfounded belief. Many of these ministers believe their
legitimacy derives from such government approval and not from God, however to exchange the headship of Christ for
unneeded state favors is to willingly declare your ministry is NOT a church
but a privileged government entity with its ability to speak God's whole truth
shut down by the ruling “Caesar” of the day.
Section IV – Does the
IRS Require Churches to Seek Tax Exemption
The
short answer is that they do not because the IRS cannot grant an exemption
unless an organization first seeks to be subject to and governed by all of the rules
and requirements under the 501 (c)(3) code. In fact the IRS makes it clear in its own publication #1828 Tax guide for Churches and Religious
Organizations on page 3 that "churches need not apply".
Section A: Automatic Exemption for Churches
Their publication says “Although there is no
requirement to do so, many [which means not all] churches
seek recognition of tax-exempt status from the IRS”. However, while most
people believe that the IRS confers the
exemption to the churches the IRS says plainly that churches need have nothing
at all to do with the IRS and if you don't read that slowly and carefully you
will miss the important Constitutional point. “There is no requirement to do so" is an understatement because
the Constitution actually prohibits the federal government from requiring
anything of churches unless churches ask for government control. Did you hear
that? No? “The Constitution PROHIBITS the federal government from requiring
anything of churches UNLESS churches ask for government control”, which means
that CHURCHES MUST ON THEIR OWN ASK FOR & SEEK AFTER 501 (c)(3) exemptions
control. This means that churches are
in fact seeking to be ruled by the IRS when they are should know that
they already are immune to taxation from the IRS. In addition, other private
and public organizations such as Wal-Mart also recognize a church's tax
immunity so why does any Church need a 501 (c)(3)? The IRS does not confer immunity to taxation on churches,
but it only "recognizes" a churches immunity because it is the Constitution
that secures church immunity from all taxation. So the bottom is that while these
churches are complying to the 501 (c)(3) rules that they have consented to
follow so they won’t lose their “tax exemptions” they have failed to realized
(or understand or do not care) that they cannot lose their tax-exempt status because it is granted under
the Constitution of the United States. This means that even if a church
were to violate 501 (c)(3) regulations it would still retain its tax exempt
status under the law land of the land because even if the IRS were to withdrew
its formal recognition of
the church's tax-exempt status it would NOT MATTER. In other words the IRS
cannot withdraw a Churches tax exempt status because it never conferred it to
them in the first place; the Constitution did.
This should tell us that churches accepting 501
(c)(3) status are just another example of churches crossing boundaries while seeking and consenting to the jurisdiction of
the federal government (playing footsy with the world). This means that whatever
the federal government sets into motion under the 501 (c)(3) program churches governed by 501 (c)(3) rules
must OBEY and most of these rules and regulations are contrary to God's Word.
Let us bring this closer to modern times and current issues such as homosexual
marriage. If churches were to start criticizing homosexual marriages or
criticizing politicians who are in favor of it from their pulpits they then could
be considered a church that is involving itself in politics and social matters which
is an IRS 501 (c)(3) NO-NO! Also, this could in fact include just about anything
that the government would ever deem as “hate
speech” and churches entangled in this 501 (c)(3) trap would have no choice but
to follow the 501 (c)(3) rules or get out, but since they get tax exemption
from the law of the land then why would they ever get involved in the 501
(c)(3) program in the first place? As the ancient philosopher Aristotle once said
“the words are important”. So
here is the word break down… Recognition here implies the preexistence of some
condition [such as tax immunity] but confer means to create some condition. The
words "recognition" and "confer" cannot be synonymous
because they contradict each other. If you would like to read a short history

Section B: 501 (c)(3)
Facts Excerpt
“Most churches in America have organized as
501 (c)(3) tax-exempt religious organizations. This is a fairly recent trend
that has only been going on for about fifty years. Churches weren’t added to
section 501c3 of the tax code till 1954. We can thank Sen. Lyndon B. Johnson
for that and know this, Johnson was no ally of the church. As part of his
political agenda, Johnson had it in mind to silence the church and eliminate
the significant influence the church had always had on shaping ‘public policy’.
Although Johnson proffered this as a favor to churches this favor also came
with strings attached (aka shackles). One need not look far to see all of the
devastating effects of 501 (c)(3) acceptance has had to the church and the
consequent restrictions placed upon any 501 (c)(3) church. 501c3 churches are
prohibited from addressing in any tangible way the vital issues of the day”.
Section C: Churches Are Not Required
So you can see from this that maybe the
reason your church preaches milky-toast spineless “non-repentance” or “non-sin”
sermons is because they attached to and following 501 (c)(3) regulations that
they were told to follow. This simply means that they are actually following
the rules that satan has placed on these churches because these churches have accepted
the world’s system of control! Even though many churches “may” be operating
from traditions, beliefs, or presumptions it does NOT matter and it does not
make them guiltless. The only thing that matters is what the law says and the
law says that churches are exempt from taxes and they DO NOT need to be under the
rule of 501 (c)(3) regulations. Can a ministry be a true church when it
agrees not to speak God's Word? Not according to the Word of God! So how did
God expect HIS Church to operate?
Section V – The Bibles Rebuttal
This
section is probably the most controversial of all because people always want to
interject their opinion or the opinion of the current building that they are
attending. However, as I said earlier is does not matter what we believe or
think about something because if our beliefs are not based on the Word of God
then they are WRONG! It also does not matter what our Constitution says because
our final answer to everything MUST be based on God’s Word and not some manmade
parchment and in Mark 12 we read how Jesus answered the Pharisees when they
asked him about taxes. Mark 12:14-17 reads this way “…when
they were come they say unto him, Master, we know that thou art true, and cares
for no man for thou regards not the person of men, but teaches the way of God
in truth: Is it lawful to give tribute to Caesar, or not? Shall we give, or
shall we not give? But he, knowing their hypocrisy, said unto them, why tempt
ye me? Bring me a penny, that I may see it. And they
brought it. And he saith unto them, whose is this image and superscription? And
they said unto him, Caesar's and Jesus answering said unto them, Render to
Caesar the things that are Caesar's, and to God the things that are God's. And
they marveled at him”. Did you notice that Jesus did not say “NOT” to pay taxes
only during his time? Now I can hear many of you saying “but our government
says we can”. Well, I here to tell you that it doesn’t matter WHAT your
government says you can do because if you are a disciple of Jesus Christ then he
overrules your government and your Constitution and in no way are they the same.
You have to understand that the Constitution was written by men who were deists
and freemasons, but the Bible was written by GOD himself and it is heresy to
say that the Constitution and God’s Holy Word are related in anyway. Yes, the
Constitution does enact many of the laws of the “10 Commandments”, but Jesus
changed that because HIS Church is under a New Covenant! You see Saints, Jesus
intended his Church to pay taxes so that there would be nothing that the world
could hold over its head (like all those pesky 501 (c)(3) regulations). So how
was God’s Church supposed to operate?
God’s
Setup Of The Church
Acts tells us that they (the Church) “…continued stedfastly in the apostles' doctrine and
fellowship, and in breaking of bread, and in prayers and fear came upon every
soul: and many wonders and signs were done by the apostles and all that
believed were together, and had all things common; and sold their possessions
and goods, and parted them to all men, as every man had need and they
continuing daily with one accord in the temple, and breaking bread from house
to house, did eat their meat with gladness and singleness of heart, praising
God, and having favor with all the people. And the Lord added to the church
daily such as should be saved” (Acts 2: 42-47). It must be said here that NO
WHERE did God EVER rescind this model for his Church, and it was only when the
apostate “roman catholic church” was legitimized under Emperor Constantine that
things began to change such as corruption of God’s Word and the total corruption
of God’s Church. If you read Acts 2 it is very clear what how God wanted his
Church to be run, but as greed and corruption swept into the Church this model
was swept aside and the apostate RCC popes and priests began to run the Church
however they wanted to and this is when it all went downhill. Go walk into your
everyday Catholic church or even your favorite mega-wolf’s church (and
especially their homes) and think about what you are seeing around you. If you
are honest you will see a TOTAL waste of God’s money and that wasted money
should have been used to make sure that the needs of GOD’S CHURCH were met
because “THEY had ALL things common; and sold their possessions and goods, and
parted them to All men, as every man had NEED and they continuing daily with
one accord in the temple, and breaking bread from house to house”! This is why
the first 3 centuries of believers after Jesus was taken into heaven had SUCH
an impact on the world. Were they tied down to jobs? NO! Were they tied down to
some ancient 501 (c)(3) program? NO! Why Not? Because they sold everything they
had to make sure the needs of their brothers and sisters were met and this does
NOT happen today. I tested several of the mega-wolves to see if they would help
when my wife and I needed help (a measly $3k) and all I got was a “go in peace”
and “we will be praying for you”. When I replied back with 1 John 3:17 “But
whoso hath this world's good, and sees his brother have need, and shuts up his
bowels of compassion from him, how dwell the love of God in him” I never heard
from them again so maybe this is why 1 John 3:18 says “My little children let
us not love in word, neither in tongue; but in deed and in truth”. I have also wondered
sometimes how many times they actually prayed for my wife and I, but that answer
will have to wait for the Judgment Seat…
Now if you do not think God
was serious in Acts 2 here is what he says in Acts 4:34-37 “Neither was there
any among them that lacked: for as many as were possessors of lands or houses
SOLD them, and brought the prices of the things that were sold, and LAID them
down at the apostles' feet: and distribution was made unto every man according
as he had NEED and Joses, who by the apostles was surnamed Barnabas, (which is,
being interpreted, The son of consolation,) a Levite, and of the country of
Cyprus, having land, sold it, and brought the money, and laid it at the
apostles feet”. Do you see the pattern? They sold EVERYTHING and let the
leaders of the Church (not churches) handle it and distribute it as the needs
of the Church came up. I have heard many of these wolves preach on “they did
not lack”, but conveniently they leave off the part about how it was done; you
know how they sold everything they had and let the Church handle it. Communes
got a real bad rap in the 1960’s, but if you read Acts and then read the history
of the Church you will see that they were basically communes and I have
wondered many times why God did this and then one day it hit me. God set it up
this way so there would be no prima donnas in the Church and that EVERYONE in
his Church would be equal. Now I also understand that he did it this way so that
there would never be a need for a 501 (c)(3) tax exemption or any other type of
exemption because Jesus does not want his Church beholding to the world!
As with everything in the
Word it is up to us at the end of the day to decide if we are going to follow
it because God was very clear in James 1:22 when he said “Be ye doers of the
Word and not hearers only, deceiving your own selves”. You see God did not tell
the Church to sell all it had so it could suffer, but so that the Church would be
able to take care of itself thus not caring about the paying of taxes or being
under any rules & regulations of the world. All the 501 (c)(3) was designed
to do was to enslave God’s Church and not “help” it. So should God’s Church cheat
the government out of taxation money? We have to remember that our Lord knew in
33 A.D. about the Constitutional exemptions that we would have in 2017 and about the
501 (c)(3) trap that Johnson would set in 1954 so since Jesus himself said to
pay our taxes what should we as a Church be doing?
I know this has been a lot
of material, and all I ever ask anyone to do is to pray about it and then go
dig into the Word because once again God’s Word has to be our final authority
and not our beliefs or traditions!
